Generally speaking, all building and demolition work requires an approval from Council. Council issues these approvals under the Environmental Planning & Assessment Act 1979 (the Act).
Under the Act, development can be classified into several different categories. If what is proposed is common or routine (e.g. a swimming pool), with predictable and minimal impact on the environment, it may be classified as 'Complying Development'.
Council's
Development Control Plan (DCP) No.6 - Exempt Development & Complying
Development lists the types of development considered as complying
development in Lane Cove. It is necessary that the applicant establish
to their satisfaction whether or not their proposal is one capable
of being dealt with as complying development, i.e. the proposal
must comply with all the set criteria in Council's DCP.
WHY LODGE AN APPLICATION FOR A COMPLYING DEVELOPMENT CERTIFICATE
If a proposal meets the Complying Development standards in Councils DCP, then council or an accredited certifier must issue a complying development certificate within seven (7) days of lodgement of the application.
HOW DO I MAKE AN APPLICATION UNDER COMPLYING DEVELOPMENT?
A Complying Development proposal is a form of development that requires approval.
If a proposal
meets the Complying Development standards in Council's DCP, an application
can be lodged for a Complying Development Certificate. If your application
is successful, a Complying Development Certificate will be issued
to you subject to certain conditions.
To make an application to Council under Complying Development:
- Obtain
an application form from council's website or from Council's
Customer Service Centre.
- Submit the completed application form and checklist
at Council's Customer Service Centre.
Please note that the checklist forms a part of your application to council. Take the time to read the information sheets then complete the checklist fully and accurately so that no unnecessary delays will occur in receiving and processing your application.
If a proposal does not meet the Complying Development standards (or exempt development standards), a development application will be required.
WHO CAN ISSUE A COMPLYING DEVELOPMENT CERTIFICATE?
A Complying Development Certificate can be issued by Council or a privately Accredited Certifier.
If lodging the application with an Accredited Certifier, the Accredited Certifier is to ensure the adjoining property owners are notified of the proposed development within 7 days after the issue of the certificate.

or with a credit card (MasterCard and VISA only). You may also pay
by credit card by mail or fax by using our Credit Card Payment Authorisation
