Step 2 - Check if DA required

 

So now you know your zone, and you have read whether or not your development is permissible, it’s time to work out what approvals are necessary.

Generally speaking, all building and demolition work requires an approval from Council. Development can be described as anything involving building works, landscaping works and/or the use of land or a building.

Development proposals can be divided into three major categories:

1. Exempt development - development that does not require development consent.

2. Complying development –development that requires consent. A simplified approval process for minor building works.

3. All other development – development that requires consent. A development application must be lodged and considered by Council.

1. EXEMPT DEVELOPMENT

A proposed development is considered to be 'exempt development' if it will have a minimal impact on the local environment (e.g. small fences and barbecues). You do not need Council approval to undertake exempt development.

Please be aware that exempt development cannot be undertaken on land comprised of a heritage item.

2. COMPLYING DEVELOPMENT

If a proposed development is common or routine (e.g. swimming pools) it may be classified as 'complying development'. A Complying Development Certificate is necessary to undertake complying development however council or an accredited certifier must issue the certificate within seven (7) days of lodgement of the application.

A Complying Development Certificate can be obtained from Council or a private accredited certifier. If your application is successful, Council or the certifier will issue a certificate to you subject to conditions.

3. ALL OTHER DEVELOPMENT

If a proposal could have a significant environmental impact, or it is not common or routine, you will need to lodge a Development Application (DA) with the council.

A Development Application (DA) is an application made to Council seeking consent to;
o construct,
o subdivide,
o change the use of a property or premises,
o demolish a building,
o display advertising,
o undertake earthworks, or
o make alterations or additions to a building.

Lane Cove Council will assess the impact of your proposed development on the local area. If your application is successful, Council will give development consent, usually subject to conditions.
