At the Ordinary Council Meeting on 18 March 2019, Council resolved to consult with the community in relation to a new Draft Code of Conduct and associated Procedures for Administration of the Code (Procedures).
The Draft Code of Conduct and Procedures was developed in line with the Model Code made under the Local Government Act 1993 and the Local Government (General) Regulation 2005.
Key changes include:
- The incorporation of pecuniary interest provisions previously contained in the Local Government Act 1993 and Regulation;
- New standards relating to discrimination and harassment, bullying, work health and safety, behaviour at meetings, access to information and maintenance of Council records;
- Clearer rules governing the acceptance of gifts including mandatory reporting; and
- The provision of ongoing disclosure requirements, including disclosure in returns of interests by a Councillor who is a property developer or a close associate of a property developer.
Council must adopt at a minimum the standards set out in the Model Code of Conduct and Procedures. Additionally, Council may include supplementary provisions and/or impose more onerous requirements. It cannot, however, include provisions that dilute the standards prescribed in the Model Code of Conduct. Council has not proposed to implement any amendments or supplementary provisions.
Community consultation was undertaken to ascertain the community's views on the new Draft Code of Conduct, specifically if additional supplementary or more stringent provisions may be appropriate.
No submissions were received in response to this consultation. A report was prepared for consideration by Council at the Ordinary Council Meeting of Monday, 20 May 2019 where council resolved to adopt the new Code and Procedures for the Administration of the Code.
18 March 2019 - Draft Code of Conduct endorsed by Council for public exhibition
21 March to 9 May 2019 - Exhibition period for community submissions
May 2019 - Evaluation of submissions received during exhibition period. Amendments incorporated into the Draft Code of Conduct as required.
20 May 2019 - Results of community consultation and final Draft Code of Conduct presented to Council for consideration and adoption.
