Draft Code of Conduct and Associated Procedures

Background

At the Ordinary Council Meeting on 18 March 2019, Council resolved to consult with the community in relation to a new Draft Code of Conduct and associated Procedures for Administration of the Code (Procedures). 

The Draft Code of Conduct and Procedures have been developed in line with the Model Code made under the Local Government Act 1993 and the Local Government (General) Regulation 2005.

Key changes include:

  • The incorporation of pecuniary interest provisions previously contained in the Local Government Act 1993 and Regulation;
  • New standards relating to discrimination and harassment, bullying, work health and safety, behaviour at meetings, access to information and maintenance of  Council records;
  • Clearer rules governing the acceptance of gifts including mandatory reporting; and
  • The provision of ongoing disclosure requirements, including disclosure in returns of interests by a Councillor who is a property developer or a close associate of a property developer.

Council must adopt at a minimum the standards set out in the Model Code of Conduct and Procedures.  Additionally, Council may include supplementary provisions and/or impose more onerous requirements.  It cannot, however, include provisions that dilute the standards prescribed in the Model Code of Conduct.  At this time, Council is not proposing to implement any amendments or supplementary provisions. 

The purpose of this consultation is to ascertain the community's views on the new Draft Code of Conduct, specifically if additional supplementary or more stringent provisions may be appropriate.
