Council recently consulted with the community in accordance with the Environmental Planning and Assessment Act, 1979 & Regulation 2000 on proposed amendments to the Lane Cove Local Environmental Plan 2010 (LEP). Ministerial delegation has not been issued to Council for this proposal.
The proposal seeks to increase the LEP building height for 1-13A Marshall Avenue from 65 metres to 94 metres.
Increasing the building height is intended to permit building forms with improved outcomes specifically in terms of overshadowing, with one building height to be lower and the other building to be higher.
In connection with the Planning Proposal and the future development of the Site for a mixed use building, the Council and the developer have negotiated a draft Voluntary Planning Agreement. A general summary of the terms and contributions to be made under that Voluntary Planning Agreement is contained in the "Explanatory Note" accompanying the exhibition of the Voluntary Planning Agreement.

A post consultation report was considered by Council at the Ordinary Council Meeting of 7 December 2015 where it was resolved that the LEP
Planning Proposal 22 for 1-13A Marshall Ave, St Leonards be adopted and
submitted to the NSW Department of Planning & Environment for finalisation,
and the VPA be executed.
