The NSW Government has recently adopted State Environmental Planning Policy (Exempt and Complying Development Codes) Amendment (Low Rise Medium Density Housing) 2017, the Medium Density Housing Code and associated Design Guide.
The new Medium Density Housing Code and Design Guide will supersede Council's planning controls by permitting terraces/townhouses in the R2 zone and allowing multi-dwelling housing to a height of 8.5 metres, overriding Council's height control of 5 metres. This would not have been consistent with Council's long standing planning approach to only permit low-scale single storey villas in the R2 Low Density Residential Zone.
In accordance with the Environmental Planning and Assessment Act 1979 & Regulation 2000 and the Local Government Act 1993, Council is consulting with the community on a planning proposal to permanently prohibit the land use 'multi-dwelling housing' in the R2 Low Density Residential Zone. Ministerial delegation has not been issued to Council for this proposal.
Council submitted a Planning Proposal to remove the land use 'multi-dwelling housing' from the R2 Low Density Residential zone and any planning controls that support it. This is not only justified by Council's long-standing policy of prohibiting 2-storey multi-dwelling housing in the low density zone, but critical to maintaining local character and built form. Two-storey multi-dwelling housing would, however, still be permitted in the R3 Medium Density Residential Zone.
The overall intent is to prohibit 'multi-dwelling housing' in the R2 Low Density Residential Zone so that this form of development cannot occur in this zone. Therefore, the existing height and floor space ratio controls that relate to 'multi-dwelling housing' in the R2 Low Density Residential Zone are no longer needed and are being deleted altogether (points 2 and 3 below). This removal of the controls is part of the legal process to prohibit 'multi-dwelling housing' in the R2 Low Density Residential Zone. All other planning controls will remain.
Purpose of Planning Proposal 33
The proposed LEP amendments seek to:-
- Permanently prohibit the land use 'multi-dwelling housing' in the R2 Low Density Residential Zone;
- Remove the height control for multi-dwelling housing in the R2 Low Density Residential zone; and
- Remove the floor space ratio control for multi-dwelling housing in the R2 Low Density Residential zone.
