A planning proposal was lodged with Council on 11 November 2016. The owners proposed amendments to the current permissible uses in the B1 zone which would permit a 130-bed residential care facility above age-related retail uses on the site. Height and Floor space ration were proposed to be increased (see below).
At its 20 February 2017 Meeting, Council resolved not to support the planning proposal (see Council Report). A Rezoning Review was then lodged by the applicant on 27 February 2017 and referred to the Sydney North Planning Panel for consideration.
On 2 May 2017, the Sydney North Planning Panel considered the views of NSW Planning and Environment, Council and the applicant as part of the Rezoning Review process. The Panel determined (see Panel Report) that the Northwood Shops Planning Proposal demonstrated both strategic and site-specific merit and that it be submitted for a Gateway Determination.
As a result of the Rezoning Review determination, the Planning Proposal was submitted to NSW Planning and Environment for a Gateway Determination on 14 July 2017. Gateway was conditionally approved on 26 September 2017 (see Gateway), subject to the Planning Proposal addressing several conditions.
The applicant submitted amended plans on 3 November, 2017. These were assessed by Council officers and found to have not addressed several Gateway conditions relating to SEPP19 bushland and to traffic assessments (reported 15 January 2018). The applicant resubmitted amendments on 24 January and 9 February 2018.
In accordance with the Environmental Planning and Assessment Act 1979 & Regulation 2000 and the Local Government Act 1993, Council consulted with the community on the amendments to the Lane Cove Local Environmental Plan (LEP) 2009.
The proposed LEP amendments seek to:-
- Retain existing Land Use zonings on site;
- Insert a permissible use to allow 'seniors housing' on the subject site.
- Increase the height limit to RL 70.250 (height to underside of top level ceiling); and
- Increase the floor space ratio of the entire site to a maximum of FSR 1.98:1.
A draft Development Control Plan has also been prepared, by the applicant, for these amendments.

A community information session was held in the Terrace Function Room at the Lane Cove Community Hub, 1 Pottery Lane, Lane Cove, on Wednesday, 14 March 2018 from 6pm to 8pm.
A report to Council will summarise the outcome of consultation with the community and relevant agencies such as the RMS. Council meeting will be recommended to support, defer or refuse the Planning Proposal.
Council then forwards its decision to the Dept of Planning, who either support Council's decision, or reject it or modify it.
