Disclosure of Political Donations and Gifts

 

Ban on Donations from Property Developers

The Election Funding and Disclosures Amendment (Property Developers Prohibition) Act 2009 provides that Councillors are not allowed to receive political donations from property developers and property developers are not able to make political donations to Councillors. Loans are also considered as political donations, however party membership is not a donation if it is less than $1000.

A “property developer” is:

a. a corporation engaged in a business that regularly involves the making of relevant planning applications by or on behalf of the corporation in connection with the residential or commercial development of land, with the ultimate purpose of the sale or lease of the land for profit, or
b. a person who is a close associate of a corporation

Donations from Others

For any other person or corporation making a donation to a councillor, Section 147 of the Environmental Planning and Assessment Act requires "reportable" political donations (exceeding $1000) to be declared by applicants and any person lodging a submission in relation to development applications. The following outlines the requirements in detail.

Lodging an Application

Any person lodging an application must declare if they have, within the preceding 2 year period, made any “reportable” donations/ gifts at the time they lodge:

• A request for the making of a local environmental plan (LEP) or development control plan (DCP)

• An application for development consent under Part 4 (or the modification of a development consent).
• An application for state significant development (to the Minister) under part 3A
• An application for a concept plan, or its modification (to the Minister) under Part 3A
However, applicants for complying development certificates and applications on behalf of a public authority are exempt.

If you have made a reportable political donation (exceeding $1000) to a Lane Cove Councillor or made a gift to a Lane Cove Councillor or employee, these details must be disclosed on the Development Application form.

Lodging a Submission

Any person making a submission in relation to any of the above applications must also make a declaration, if they have made a reportable political donation (exceeding $1000) to a Lane Cove Councillor or made a gift to a Lane Cove Councillor or employee, within the preceding 2 year period. A Disclosure Statement Form must be submitted with the submission.
