Status - Notified (gazetted) on Friday 18 January 2013. Community Consultation A public exhibition of the draft LEP amendments was held for eight weeks from 27 January to 23 March 2012. Council's exhibition followed the completion of a Strategic Review undertaken for the precinct bounded by Mowbray Rd, Centennial Ave, Willandra St and Batten Reserve by the Department of Planning & Infrastructure in conjunction with Council in 2011. In light of a number of serious concerns raise in relation to rezoning the Mowbray Precinct for high density development Council demanded State Government Action. June 2011 Following discussions, the Department of Planning and Infrastructure (DoP), in collaboration with Council, commenced preparation of a joint technical strategic review of the Mowbray Road precinct. This collaborative effort allowed Council and the DoP to ensure that the most appropriate planning outcome is realised for the precinct. July 2011 View the Mowbray Road Strategic Review, Lane Cove Fact Sheet August 2011 Council and the DoP commenced a technical strategic review to examine whether the current planning controls are appropriate. The review examined the development potential and infrastructure needs. A project control group, with representatives from both Council and the DoP, was formed to guide the direction of the review process. September 2011 At its meeting of 5 September 2012 the Mayor delivered a Speech to Council providing an update on the Mowbray Road Precinct and Council resolved unanimously to make appropriate representations to the NSW Premier and the NSW Minister for Planning and Infrastructure and seek the support of the Member for Lane Cove, Anthony Roberts, in order to:- - Fast-track the Mowbray precinct Strategic Review;
- Ensure the subsequent Gateway process is conducted in the most timely manner;
- Encourage the return of more planning powers to our community in line with State Government commitments; and
- Highlight the negative consequences to our ratepayers caused by such planning decisions and processes.
December 2011 The technical strategic review examining the development potential of the Mowbray Road precinct in Lane Cove was completed by Council and the DoP. It was presented to Council at the Ordinary Council Meeting of Monday 5 December. For further details you can read the:- January to March 2012 Following the Strategic Review of the Mowbray Precinct, undertaken in 2011 by the Department of Planning & Infrastructure and Council, a series of amendments to the Local Environmental Plan 2009 was endorsed in early December 2011 by Council and the Department for public exhibition. April 2012 Following its meeting of 16 April 2012 and the consideration of the Mowbray Precinct Post-Exhibition Report, Council submitted a Revised Planning Proposal to the Department of Planning and Infrastructure on 30 April 2012. 15 October 2012 Council endorsed the plan to seek finalisation by the Department (see Report). November 2012 The Department has advised that the Mowbray Precinct Planning Proposal is with Parliamentary Counsel's Office seeking notification (gazettal). 18 January 2013 The NSW Department of Planning and Infrastructure officially gazetted the Local Environmental Plan (LEP) amendment for the Mowbray Road precinct. The amendment takes effect from Friday 18 January 2013. The amendment included changes to the following maps: The subsequent Development Control Plan (DCP) amendment for the Mowbray Road precinct already adopted by Council will take effect from Friday 25 January 2013. Council Reviews Its Options Regarding Bushfire Risk In Batten Reserve Following unfavourable rulings by the Land & Environment Court in relating to high density development in the Mowbray Precinct, Council reviewed its options regarding continued legal action. Transport Studies The DoP and Council engaged strategic transport and master planning consultants, to undertake investigations as part of the Mowbray Road Strategic Review. Residents were advised that subcontractors/consultants would be in the study area collecting data during September, and in particular, will be performing traffic counts.
