Proposed Local Environmental Plan (LEP) Amendments

 

​Lane Cove's Local Environmental Plan (LEP) 2009 came into effect on 19 February 2010.

The LEP provides increased zones for housing and jobs growth under the Metropolitan Strategy for Sydney, and new environmental and other controls, and was one of the first introduced in Sydney under the NSW LEP Standard Instrument.  

After 12 months of monitoring the LEP in operation, a review commenced to fine-tune the development controls and incorporate community suggestions made since the drafting of the LEP.  

A staged series of LEP amendments have been approved by the Department of Planning & Infrastructure for exhibition, and the detailed documents may be viewed below.

To have your say on any of the planning proposals currently on public exhibition please make a submission to the General Manager by:-

Please include the appropriate reference number (e.g. 5/2011) as listed against the planning proposals outlined below.

4/2011: Classification of Reserves

Proposal - To reclassify a number of drainage reserves, and one public reserve lot, to operational from community land (under the Local Government Act 1993 and Environmental Planning & Assessment Act 1979).

Status -  The submission deadline for this consultation has now closedCouncil resolved the matter at its Ordinary Council Meeting of 18 June 2012.

A public hearing was held at 9am on Thursday 31 May 2012 in the Council Chambers at the Lane Cove Civic Centre (48 Longueville Rd, Lane Cove).  The public were invited to attend the meeting and address the Commissioner and/or hand in written submissions and/or observe. It was not essential to register beforehand.

Those unable to attend the public hearing were invited to make a written submission to Council by 31 May 2012, quoting the reference 'Planning Proposal 4/2012, SU4468'.  Submissions made during the during Councils exhibition were also be considered by the Commissioner and did not need to be resubmitted.

Following the Public Hearing, a report on the proposal was presented to Council at its Ordinary Council Meeting of 18 June 2012.  Council resolved to:-

1.   Note the Public Hearing report by Dr Ian Ellis-Jones dated 5 June 2012.

2.   Defer the planning proposal to remove the restrictions as to user and standard caveat i.e. Standard Caveat K200000P and Q23852 applying to the public reserve in Fleming Street (Lot 9 DP 253441)

3.   Defer consideration and refer to the next Inspection Committee Meeting the proposal to reclassify the following three reserves to operation from community land:-

a.   89A Centennial Avenue and Hallam Avenue (Lot 114, DP 9653);

b.   26A Garling Street (Lot 13, DP 19114); and

c.   Fleming Street (west of 29A) (Lot 9 DP 253441)

and to remove public reserve status including obtaining any appropriate approval of the Governor under section 30(2) of the  Local Government Act 1993.

4.   Not proceed to reclassify the other reserves exhibited in draft Planning Proposal 4/1011:-

5.   Write to all those who made submissions to the public exhibition and public hearing, advising them of the Council’s resolution and the availability of the Public Hearing Report on Council’s website and at Council offices.
